1. Acceptance of terms
These Terms of Service (the “Terms”) govern your use of horizonaircare.com, quote.horizonaircare.com, and any services provided by Horizon Aircare doing business as Horizon Aircare (“Horizon Aircare,” “we,” “us,” or “our”). By using the site, requesting a quote, or hiring us, you agree to these Terms. If you do not agree, do not use the site or our services.
2. Eligibility
You must be at least 18 years old and have legal authority to enter into a contract on behalf of the property to be serviced. If you are booking on behalf of an owner, landlord, HOA, or business, you represent that you are authorized to do so.
3. Description of services
Horizon Aircare offers the following home services in South Florida:
- Air duct cleaning.
- Dryer vent cleaning.
- Attic insulation — blow-in installation and removal.
- Installation of chimney caps and dryer vent guards.
Insurance status. Horizon Aircare is insured. Florida does not require a state contractor license for the services listed above, and Horizon Aircare does not hold or claim a state contractor license, a mold remediator license, or any other professional license for these services. We do not provide mold remediation, mold inspection, or mold testing services.
4. Quotes and estimates
On-site estimates are free. Quotes are valid for 30 days from the date issued unless we tell you otherwise in writing. The final price for any job is the price approved by you, in writing or verbally, before work begins. If we discover unforeseen conditions during the job — for example concealed damaged or collapsed ductwork, hazardous materials, rodent infestation, or other conditions that materially change the scope — we will pause work and provide a revised quote for your approval before continuing.
5. Scheduling, arrival windows, and access
You must provide reasonable access to the property at the scheduled appointment window, including driveways, attics, crawl spaces, and exterior vent terminations relevant to the job. If no authorized adult is present, access is denied, or we cannot safely perform the work upon arrival, a trip fee of $79 may apply.
6. Customer responsibilities
Before we begin work, you must:
- Disclose any known hazardous conditions on the property, including the known or suspected presence of asbestos, lead-based paint, suspected mold, active water damage, or pest infestations.
- Clear or move personal items near work areas (around the dryer, attic access, exterior vent terminations, registers, and returns).
- Secure pets in a separate area for their safety and ours.
- Provide working power and water access as needed.
- Ensure an authorized adult is present at the property during service.
7. Payment terms
Payment is due upon completion of the work unless we agree to written financing terms. We accept the payment methods listed at the time of booking. A returned-payment fee of $35 may apply to any failed credit card chargeback, bounced check, or reversed ACH. Past-due balances may accrue interest at the maximum rate allowed by Florida law.
8. Warranties and disclaimers — AS IS
All services and any installed materials are provided “AS IS” and “AS AVAILABLE,” without any warranty of any kind, express or implied. Horizon Aircare expressly disclaims, to the maximum extent permitted by Florida law, all implied warranties, including the implied warranties of merchantability, fitness for a particular purpose, workmanship, habitability, and non-infringement.
No workmanship warranty, satisfaction guarantee, or service guarantee is offered or implied unless Horizon Aircare issues a specific written warranty for the specific job, signed or expressly issued by an authorized representative, that identifies the exact scope and duration of the warranty. Marketing copy, website language, sales statements, technician statements, and ad creative do not create any warranty.
Manufacturer warranties. Any warranties on materials installed by us — including chimney caps, dryer vent guards, and insulation products — are provided solely by the manufacturer and are passed through to you. Horizon Aircare is not the warrantor of those products.
Health and air-quality disclaimer. Horizon Aircare makes no representation, promise, or guarantee regarding health outcomes, allergy or asthma relief, energy savings, odor elimination, or any specific air-quality result. Our services are not medical services and are not a substitute for medical advice, diagnosis, or treatment. Quantitative figures that may appear in marketing materials (for example, “up to X% energy savings”) are estimates only and are not guarantees.
Website “as-is” disclaimer. The website and all content on it are provided as-is, without warranty of any kind. We do not warrant the accuracy, completeness, or availability of the site.
9. Limitation of liability
To the maximum extent permitted by Florida law, Horizon Aircare’s total liability to you arising from or related to the services or this agreement is limited to the amount you actually paid us for the specific service that gave rise to the claim. Horizon Aircare is not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost data, business interruption, or loss of use, even if advised of the possibility of such damages. Some jurisdictions do not allow these limitations; in those jurisdictions our liability is limited to the smallest extent permitted by law.
10. Indemnification
You agree to defend, indemnify, and hold harmless Horizon Aircare and its owners, employees, contractors, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your misuse of the site or services; (b) your breach of these Terms; (c) any condition of your property you did not disclose; or (d) any third-party claim arising from your property or your representations to us.
11. Intellectual property
All content on the site — including text, graphics, photos, logos, video, and code — is owned by Horizon Aircare or its licensors and is protected by copyright, trademark, and other laws. You may not scrape, copy, reproduce, redistribute, or create derivative works without our prior written permission.
12. User content
If you give us reviews, testimonials, photos, or communications about the work we perform, you grant Horizon Aircare a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in our marketing, on our website, and on third-party platforms, with attribution or anonymized as we choose. You can withdraw this license going forward by contacting us, but already-published uses may remain.
13. Prohibited conduct
You agree not to scrape, reverse-engineer, or copy the site; submit fraudulent quote requests; impersonate any person; abuse, threaten, or harass our staff or technicians; or interfere with the security or operation of the site.
14. Electronic communications consent
You agree that we may provide quotes, contracts, invoices, receipts, service updates, warranty notices, and other legal notices to you in electronic form — by email, SMS, or through the site — and that these electronic communications satisfy any legal requirement that the communication be in writing.
15. Dispute resolution
Governing law. These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules.
Venue. Subject to the arbitration agreement below, any court action must be brought in the state or federal courts located in Broward County, Florida, and you consent to personal jurisdiction there.
Informal resolution first. Before starting a formal proceeding, you agree to send written notice of the dispute to info@horizonaircare.com or 5840 Lakeshore Dr, Fort Lauderdale, FL 33312 and give us 30 days to resolve it.
Binding arbitration. If we cannot resolve the dispute informally, you and Horizon Aircare agree to resolve any dispute arising from or related to the services or these Terms by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration is conducted on an individual basis only.
Class action waiver. You and Horizon Aircare each waive any right to participate as a class representative or class member in a class, collective, or representative action.
Jury trial waiver. You and Horizon Aircare each waive any right to a jury trial in any action arising from these Terms or our services.
30-day opt-out. You may opt out of this arbitration agreement and the class action waiver by sending written notice to info@horizonaircare.com within 30 days after the date of your first service. The notice must include your name, service address, and a statement that you opt out. Opting out does not affect any other provision of these Terms.
16. Force majeure
Horizon Aircare is not liable for any failure or delay caused by events beyond our reasonable control, including weather events, hurricanes, power outages, fires, labor disputes, supply chain disruptions, government actions, pandemics, and acts of God.
17. Severability, entire agreement, no waiver, assignment
If any provision of these Terms is held unenforceable, the remaining provisions stay in effect. These Terms, together with any signed service agreement, are the entire agreement between you and Horizon Aircare regarding the services. Our failure to enforce any right is not a waiver. You may not assign these Terms without our written consent. We may assign these Terms in connection with a sale or transfer of the business.
18. Changes to terms
We may update these Terms from time to time. The “Last Updated” date at the top shows when they were last revised. Material changes will be communicated as required by law. Continued use of the site or our services after a change means you accept the updated Terms.
